Terms and Conditions for Your Subscription Service(s) with Independent Cable Network of Trinidad & Tobago
General Terms
- These terms and conditions set out the agreement between (1) you (‘you’, ‘the customer’ or ‘your’); and (2) Independent Cable Network of Trinidad & Tobago (‘us’, ‘we’ or ‘ICNTT’ or ‘our’); for the provision and use of ICNTT’s home entertainment television services.
- The agreement between both parties is legally binding, and is governed
by the laws of Trinidad and Tobago. - Persons must be Eighteen (18) years or older to apply for and enter into our Subscription Agreement for the Service(s) we offer.
- Terms and Conditions may be updated from time to time and will be published on our website www.icntt.com.
- Your subscription for your chosen Service(s) commences when you apply for services by completing the Customer Application Form, and when the requested Service has been activated and will continue for the Term or until the specific service offering acquired are terminated or expire. The term of this Subscription Agreement is Twelve (12) Months and will auto-renew on its anniversary date, unless requested otherwise by you. This Agreement can be terminated upon request following 15 Days’ notice of termination.
- This agreement is personal to you and you may not transfer your account or any of your rights and responsibilities under this agreement without our written consent. For business reasons, we may transfer any of our rights and responsibilities under this agreement without your permission.
Programming
- Some parts of the service(s) (for example, television channels that form part of our television services and other content on, or accessible via, our television services are supplied by other organisations. As a result, due to matters outside our reasonable control or for commercial or contractual reasons, we may change, cancel or postpone all or any component part(s) of the service(s), however, ICNTT will make every effort to give you reasonable notice of any withdrawals and changes where it is possible to do so.
- The Customer agrees that specific programs on the video line up are subject to change and ICNTT reserves the right to replace entire programs at its sole discretion. The Customer is advised that there are many changing considerations affecting the availability, timing, language, cost and quality of programming. ICNTT thus reserves the unrestricted right to change, rearrange, add or delete programming channels. Customer agrees that ICNTT has no obligation to replace or supplement the programming previously offered that have been deleted or rearranged.
- The Content is copyright material of third parties who supply it, and protected by copyright and other applicable laws, and may not be reproduced, published, broadcast, rewritten, or redistributed without the written permission of the third party that supplied it.
- The Customer accepts that certain programming or broadcasts, including without limitation some subscription services, sporting events, live events or shows and broadcast network services, programmes or broadcast may be blacked out where a request for a person with certain Broadcast rights has been made.
- CONTENT RESTRICTIONS. SUBJECT TO ANY LIMITATIONS IN LAW, REGULATIONS OR OTHER LAWFUL DIRECTIVE FROM A COMPETENT AUTHORITY, THE CUSTOMER SHALL CORPORATE WITH ICNTT TO LIMIT ANY PROGRAMMING OR OTHER CONTENT THAT MAY BE UNSUITABLE FOR VIEWING BY CUSTOMER’S FAMILY, HOUSEHOLD AND GUESTS. ICNTT SHALL NOT BE LIABLE TO ANYONE DUE TO, OR BASED UPON, ANY SUCH PROGRAMMING OR CONTENT INCLUDING WITHOUT LIMITATION, ANY INACCURACIES, ERRORS IN, OR OMISSIONS FROM SUCH PROGRAMMING, OR OTHER CONTENT.
Terms of Service
- The Real TV Service will require a stable Internet connection. It is the responsibility of the Subscriber to ensure that sufficient bandwidth is available to facilitate each connection. A minimum of 4Mbps is required per connection.
- All Services do not work on all equipment or devices. If you do not have suitable equipment or devices available, the Service may not function correctly. We will not be liable for your equipment’s inability to receive the Service. We may choose not to provide Services that do not function correctly in your equipment. It is your sole responsibility to ensure technical compatibility with Our Network and the Service.
- Where we need to set up any service(s) on your equipment we will guide you through this process on the day of installation, we will also provide implementation guides as best as possible at no cost. If you are unable to complete the implementation steps and require our physical assistance, we will arrange for a home visit, we will arrange a technician visit which will incur a home visit fee.
- If it becomes necessary, you are responsible for applying for any consents and permissions necessary for us to connect and maintain the equipment at your home (for example, any permission necessary to pull cable from the street to your address). We are not obliged to install or provide the service(s) unless all consents and permissions have been obtained. Further, we are entitled to assume that all necessary consents have been obtained unless we have been provided with something in writing stating otherwise.
- All cable installation will be surface mounted. If you wish to have the installation within conduits, we can provide the cable and you can make private arrange to install within the conduit.
- Maintenance services will be provided during normal working hours that we believe are necessary for the system and equipment to work properly, to meet our standards and for us to provide the service(s) to you.
- We will always aim to provide you with the best service possible, but we will not be liable for interruptions, reception, picture degradation or other problems with the television services which are beyond our reasonable control. You agree that you will tell us about any fault in the service(s) by contacting our Customer Services team, who will aim to respond as promptly as possible.
- You are responsible for maintaining any equipment which you own (for example, television sets, TV Boxes, Mobile Devices and so on) that is relevant to the service(s).
Service Interruption
- ICNTT DOES NOT WARRANT UNINTERRUPTED USE OR OPERATION OF THE EQUIPMENT OR SERVICE. CUSTOMER’S SOLE REMEDY FOR SERVICE INTERRUPTION SHALL BE LIMITED TO A PRO-RATA REFUND. THAT ICNTT SHALL NOT BE LIABLE TO COMPENSATE ANY CUSTOMER FOR ANY INTERRUPTION OR BREAK IN TRANSMISSION OF THE SERVICE; BREAKDOWN OR FAILURE OF THE NETWORK OR ANY INABILITY BY ICNTT TO REPAIR OR REPLACE ANY ICNTT EQUIPMENT THE DURATION OF WHICH IS FOR LESS THAN TWENTY-FOUR (24) HOURS.
- ICNTT shall use its best efforts to maintain and repair the Service, Network and Equipment promptly but assumes no responsibility for the following:
- Commercial power failures;
- Cessation of transmission by radio or television broadcasting stations or television satellite programs; Statutory regulations, which may restrict, alter or otherwise eliminate certain kinds of programming;
- The failure or cessation, in whole or part, of signal delivery systems and/or other services provided by common carriers or utilities to ICNTT;
- Battery replacement in remote controls;
- Work stoppage due to labour dispute, strikes or civil unrest;
- Acts of God, including floods, storms, hurricanes, wind, lightning accidents, earthquakes and adverse atmospheric conditions;
- Sabotage, theft or intentional or malicious damage to the ICNTT Network or Equipment;
- Negligent acts of the Customer or anyone authorised thereby to use the Service; or
- Any other interruption in the Service not caused by an intentional or negligent act of ICNTT or which is beyond the control of ICNTT.
Payment and Charges
- You must pay the charges for the service(s) as set out in your agreement or as otherwise notified to you via information available at our Payment Centre, together with any applicable taxes. You can also request information on our charges by contacting our customer services team. All payments by you should be made to Independent Cable Network of Trinidad & Tobago.
- You will be billed in advance for subscription, rental and other re-occurring charges on the 1st working day of each month. If service is installed or changed during the billing period, you will be billed pro-rata.
- Failure to receive an invoice does not relieve you of your responsibility to pay the amount due. Please inform our Customer Service if you do not receive an invoice.
- You may choose to receive a paper bill instead of an electronic bill (“e-bill”). Where you have access to electronic billing (“e-billing”) but choose to receive a paper bill, you agree that we may charge you a separate fee each month for this.
- You must provide us with a valid and current e-mail address to use e-billing. The accuracy of that e-mail address is entirely your responsibility.
- All invoices will become overdue fifteen (15) days following the date of the invoice. Failure to complete on-time payments may result in the disconnection of service(s) and you shall be liable for all reasonable collection and/or legal charges incurred.
- Any claims arising from invoices must be made within three months of receipt of invoice.
- BILLING ERRORS. Subject to applicable law, Customer may notify ICNTT of any billing errors, adjustment or other requests for credit within six (6) months from the month in which the discrepancy, error or loss Service occurred.
- PRICE CHANGES – ICNTT reserves the right to change prices including the monthly fees and installation charges at any time subject to providing customers with the required 30 days’ notice as per Concession.
- RETURNED CHEQUES. All dishonoured cheques or cheques endorsed “Refer to the Drawer” are subject to the banks’ returned cheque service charge and an administrative service charge.
- RECONNECTION – No reconnection of the Service by ICNTT, in whole or in part, shall be made until the Customer pays outstanding amounts, fees, charges and costs unless waived in whole or in part by ICNTT. In the event Customer is disconnected twice within one year, ICNTT may, at its sole option, require Customer to pay an additional security deposit prior to reconnection of Service.
Misuse of Service
- Customer agrees to use the service(s) for specific agreed purposes and is not entitled to resell, trade, barter with, bypass ICNTT or other networks or redistribute services without the permission of ICNTT. ICNTT reserves the right to discontinue the provision of service to any customer who uses the service for any other reason other than personal use or as intended by Service Agreement. In instances where a customer is found to be misusing the service of ICNTT, the customer will be liable and fully responsible towards ICNTT and will hold ICNTT harmless from any claims of third parties for costs and damages due to abuse.
Customer Information
- You must provide promptly and accurately all the information which may be needed so that we can perform our respective obligations under this agreement. You must also tell us immediately if any of your details change.
- If You provide Us with false or inaccurate information and we suspect or identify fraud, we will record this and may also pass this information to any fraud prevention agencies and other organizations involved in crime and fraud prevention.
- Subject to your consent, we may use your personal information to contact you with information about our products and services, special offers and rewards, as well as those of selected third parties. From time to time, we may contact you by mail, telephone, email, other electronic messaging services (such as text, voice, sound or image messages including using automated calling systems) or fax for these purposes.
- If you change your mind at any time and no longer wish to receive this information from us, that’s okay. Just call Customer Service to request the opt out option.
Confidentiality
- ICNTT is committed to maintaining the privacy of Your Personal Information.
- Neither party will divulge Confidential Information to any
Third Party except to contractors, suppliers and agents, strictly on a need to know basis, for the purposes of the implementation and/or performance of this Agreement, unless otherwise agreed in writing with ICNTT. - ICNTT shall be entitled to keep records of Customer Information, which ICNTT shall use to perform ICNTT’s obligations under this Agreement, and for related
purposes.
ICNTT shall be entitled to disclose Customer information as required by any legal, regulatory or financial regulatory agencies or by court order, or any third party, for the purposes of providing the Services.
